Unique Cyber Cafe operates as a technology-enabled service provider offering internet services, digital facilitation, online form services, government and private digital services, and communication-based solutions including WhatsApp Official API messaging and RCS (Rich Communication Services) for business communication.

By accessing our website, availing our services, or using our messaging platforms, you acknowledge that you have read, understood, and agree to be legally bound by these Terms under the laws of India.

2. Definitions

  • “User” / “You” refers to any individual or business entity accessing or using our services.
  • “Services” means all digital, internet, messaging, communication, and facilitation services provided by Unique Cyber Cafe.
  • “WhatsApp Official API” refers to Meta-approved WhatsApp Business Platform used for transactional and consent-based messaging.
  • “RCS” refers to Rich Communication Services provided through telecom and Google-approved platforms.
  • “Content” means text, images, data, messages, and materials transmitted through our services.
  • “Platform” refers to our website, systems, dashboards, and communication tools.

3. Acceptance of Terms

By accessing our services, you confirm that you are legally capable of entering into a binding agreement under the Indian Contract Act, 1872.
If you do not agree to these Terms, you must immediately discontinue use of our services.

Continued usage constitutes unconditional acceptance of these Terms and any updates thereto.

4. Description of Services

Unique Cyber Cafe provides:

  • Internet browsing and cyber cafe services
  • Online application and digital facilitation services
  • Document printing, scanning, and submission support
  • Messaging communication facilitation using WhatsApp Official API
  • RCS messaging support for business notifications
  • Technical assistance related to digital services

We act as a facilitator and service enabler and do not control the content provided by users.

5. Eligibility

You must:

  • Be at least 18 years of age, or
  • Use the services under supervision of a legal guardian
  • Have lawful authority to share data and send messages via WhatsApp or RCS

Businesses must ensure compliance with Meta Business Messaging Policies, TRAI regulations, and applicable Indian IT laws.

6. Account Registration

Some services may require account registration. You agree to:

  • Provide accurate and complete information
  • Maintain confidentiality of login credentials
  • Be responsible for all activities under your account

Unique Cyber Cafe reserves the right to suspend or terminate accounts with false or misleading information.

7. User Responsibilities

Users shall not:

  • Send spam, promotional messages without consent
  • Transmit illegal, misleading, abusive, or harmful content
  • Violate WhatsApp, RCS, telecom, or IT laws
  • Attempt unauthorized access or data extraction

You are solely responsible for obtaining explicit user consent before messaging via WhatsApp or RCS.

8. Payment & Billing Terms

Certain services may be chargeable.

  • Fees must be paid in advance unless otherwise agreed
  • Payments are non-refundable unless legally required
  • Taxes shall be applicable as per Indian GST laws

Failure to pay may result in service suspension.

9. Subscription Renewal & Termination

Subscription services:

  • Renew automatically unless cancelled
  • Can be terminated for policy violations
  • May be suspended due to non-payment or misuse

Unique Cyber Cafe reserves the right to terminate services without notice for illegal usage.

10. Use of WhatsApp Official API & RCS

Users must comply with:

  • Meta WhatsApp Business Messaging Policies
  • Google RCS guidelines
  • Telecom regulations in India

Messages must be:

  • Transactional or consent-based
  • Non-deceptive and lawful
  • Sent only to opted-in recipients

Violation may lead to permanent service suspension.

11. Message Delivery & Compliance Policy

Unique Cyber Cafe does not guarantee message delivery due to:

  • Network failures
  • Platform restrictions
  • User device limitations

We are not responsible for blocks imposed by WhatsApp, RCS providers, or telecom operators.

12. Intellectual Property Rights

All logos, content, systems, and materials are the intellectual property of Unique Cyber Cafe unless stated otherwise.

Unauthorized reproduction or distribution is prohibited under Indian Copyright Law.

13. Confidentiality

We maintain confidentiality of business and user data except where disclosure is required by law or platform compliance.

14. Disclaimer of Warranties

Services are provided on an “as is” and “as available” basis.
We disclaim all warranties, express or implied, including fitness for a particular purpose.

15. Limitation of Liability

Unique Cyber Cafe shall not be liable for:

  • Indirect or consequential damages
  • Business losses
  • Platform-imposed restrictions

Our maximum liability shall not exceed fees paid by the user.

16. Indemnification

You agree to indemnify Unique Cyber Cafe against all claims arising from:

  • Policy violations
  • Illegal content
  • Unauthorized messaging

17. Governing Law (India)

These Terms shall be governed by and interpreted in accordance with the laws of India, with exclusive jurisdiction of courts in Pune, Maharashtra.
